Trustee Responsibilities

The Trustee Act 2000 places clear responsibilities on Trustees, as do The Money Laundering and Terrorist Financing (Amendment) Regulations 2019.

In modernising trustee law in the UK, The Trustee Act 2000 gave trustees wider investment powers, while introducing a statutory duty of care to ensure they act prudently and in the beneficiaries' best interest.
The Act includes a standard investment criteria to guide trustees in diversifying assets and balancing income with capital growth, alongside a duty to review investments and take appropriate action.

TFM is experienced in providing investment advice, and ongoing review services, to Trustees to ensure compliance with their obligations, and to promote positive outcomes for the beneficiaries.

Trustee Investment Case Study

The problem:

The problem: Becoming a Trustee for the first time

Clients JG and CD became trustees when a close relative died.

They were appointed by their relative, the settlor of the trust, because they were close relatives.

Neither has any experience as a trustee, and neither considers themselves experienced investors.

The solution:

Working with TFM helped them to understand their responsibilities with the Trustee Registration Service, and their obligations under the Trustee Act to secure appropriate advice.

TFM took the trustees through a structured process to build their understanding and to help them avoid the pitfalls.

The outcome was an investment solution that reflected the differing needs of the different classes of beneficiaries of the trust, whilst maintaining administrative and tax efficiencies for the trustees.
